DAR suspends all probes, case trials

The Department of Agrarian Reform on Sunday announced the extension of a temporary suspension of the agrarian law implementation legal proceedings and processes due to the extended Enhanced Community Quarantine.

“All scheduled hearings, on-site inspection and investigations, meetings, dialogues, mediation conferences and other proceedings pursuant to the regular or special agrarian law implementation rules are suspended until April 30, 2020,” Secretary John Castriciones said.

The proceedings shall be rescheduled by concerned DAR offices with proper notice to the concerned parties or based on the agreements of the involved parties upon the lifting of the lockdown and resumption of regular government operations.

According to Castriciones, the filing of petitions and appeals, motions, pleadings and other submissions involving all regular and special agrarian law implementation cases that fall due during the Enhanced Community Quarantine or up to April 30, 2020 is extended for 30 calendar days, counted from May 1, 2020, unless the period of quarantine is again extended.

“The period of suspension of the regular and special agrarian law implementation proceedings shall be lifted on May 1, 2020, unless a new extension of the ECQ is announced,” he said.

All DAR offices within Luzon or in areas where the lockdown likewise being implemented by their local government units shall not accept any correspondences, written queries, appearances, petitions, appeals, motions, applications or any submissions.

Castriciones said the resumption of the running of those periods shall be fixed by the DAR as soon as the lockdown is lifted.
