Makati tells owners: Comply with parking regulations

The Makati City government on Friday reminded owners of all commercial and residential buildings in the city to strictly comply with parking regulations under the implementing guidelines of the National Building Code.”©

Mayor Abigail Binay said under the law, if the setback provided was less than five meters, the curb and gutter shall be restored, and no ramp would be allowed along the sidewalk. 

She added the size of an average automobile (car) parking slot must be computed at 2.50 meters by 5.00 meters for perpendicular or diagonal parking, and at 2.15 meters by 6.00 meters for parallel parking.”© 

She said all structures in the city, whether residential or commercial, must properly observe the road right-of-way for the safety of pedestrians and motorists as well as for unimpeded traffic flow.”© 

“©“We reiterate our call to all residential and commercial building owners and administrators to comply with the parking requirements and free the sidewalk from all impediments,” Binay said.”©

“©Since sidewalks and roadway/carriageway are included in the road right-of-way, these should be equally enjoyed by the community, according to the law.

“©The Office of the City Building Official recently discovered that 139 commercial buildings and establishments in the city failed to conform with the parking regulations.”© 

“©Binay tapped CBO head engineer Elmer Acuesta to issue a memorandum reiterating the required strict compliance with Parking Slot, Parking Area and Loading/Unloading Space Requirements of the Code.

“©The pertinent provision in the revised implementing rules and regulation of P.D. 1096 states that: a) The parking slot, parking area and loading/unloading space requirements listed hereafter are generally the minimum off-street cum on-site requirements for specific uses/occupancies for buildings/structures, i.e., all to be located outside of the RROW.”© 

“©Based on a report submitted by Acuesta to the Office of the Mayor, recipients of the said notices included 12 hotels, eight banks, 17 restaurants, six condominiums/apartment buildings, 29 commercial buildings, four convenience stores, two supermarkets, and 61 other establishments.”© 

“©In line with the mayor’s directive, city government personnel have been continuously conducting inspections on buildings and establishments to monitor compliance with parking regulations. 

These include some 3,000 medium to high-rise commercial and residential buildings along major thoroughfares and in the Central Business District.

“©Violation of the said provisions will be a ground for the stoppage of use and occupancy suspension/revocation of all permits issued in accordance with Section 305 (Validity of Building Permits) and Section 306 (Non-issuance, Suspension or Revocation of Permits) of the Building Code.”© 

“©Section 305 of the Code states that the issuance of a building permit shall not be construed as an approval or authorization to the permittee to disregard or violate any of the provisions of the Code.”© 

“©Whenever the issuance of a permit is based on approved plans and specifications which are subsequently found defective, the Building Official is not precluded from requiring permittee to effect the necessary corrections in said plans and specifications, or from preventing or ordering the stoppage of any or all building operations being carried on thereunder which are in violation of the Code.”© 

“©A building permit issued under the provisions of the Code shall expire and become null and void if the building or work authorized therein is not commenced within a period of one year after the issuance of the building permit, or is suspended or abandoned at any time after it has been commenced for 120 days.

The Code says the Building Official may order or cause the non-issuance, suspension or revocation of building permits on any or all of the following reasons or grounds: a.) Errors found in the plans and specifications; b.) Incorrect or inaccurate data or information supplied; c.) Non-compliance with the provisions of the Code or any rules or regulations (Section 306).”© “©
