CA upholds decision on appeal bond

THE Court of Appeals has upheld a lower court’s decision allowing a private firm to post an appeal bond with the Department of Public Works and Highways in connection with the firm’s protest questioning the bidding process of a multimillion-peso road project in 2012.

At a media briefing, Redentor Viaje, legal counsel of RC Tagala Construction, said the appellate court issued a ruling in their favor last week and ordered the DPWH to accept the firm’s appeal bond.

The order affirmed Lucena City Regional Trial Court’s Branch 53 decision, directing the DPWH’s Quezon 1 Engineering District Office to accept RC Tagala’s bond of P256,917.75 and recognize the protect of the company in accordance with the provision of Republic Act 9184 or the Government Procurement Law.

“This case clearly demonstrates how the procurement agencies of our government offices, desperately tried to twist the law, or frustrate the spirit of the law or at least minimize the irregularities in the bidding processes,” Viaje said.
