OSS-Center officers seeking SC certiorari

Twenty one incumbent and former officers and employees of the One Stop Shop Interagency Tax Credit and Duty Drawback Center (OSS-Center) have asked the Supreme Court for certiorari and writ of prohibition after the OSS-Center had received from the Commission on Audit 11 batches of 578 Notices of Disallowances involving eight firms amounting to P2.216 billion.

In their 168-page petition filed on May 3 before the High Court, the officers and staff of OSS-Center, an agency of the Department of Finance (DoF), said through their lawyer Marlon Mercado they were prompted to file the petition for certiorari and prohibition after the CoA had answered only two of the 11 petitions they field for review.

They claimed the two answers were insufficient to address the points they had raised in their petitions for review. The petitioners have alleged CoA has not answered the nine others petitions for review.

The petitioners have sought a writ of certiorari to set aside the 578 NDS and a separate writ of prohibition for CoA to set aside the special audit report from, on which the issuance of those NDs was based.
