Solgen defends ML extension at SC

The Supreme Court resumed today the oral arguments on the extension of martial law in Mindanao.

The en banc session was conducted at 10 am.

Fourteen (14) justices were present.

SC Associate Justice Mariano del Castillo is on leave.

It was the turn of the executive branch to defend the one-year extension of martial law in Mindanao.

Solicitor General Jose Calida faced the grilling from the magistrates who are hearing the four consolidated petitions against the extension.

In defending the martial rule, Calida said the high tribunal cannot interfere in the actions of the House of Representatives.

He is referring to the complaints of the petitioners that the measure that approved the extension was supposedly passed with undue haste. 

Calida told the Supreme Court that the issue is political and non-justiciable in nature.

He added the 1987 Constitution allows Congress to determine the rules of proceedings.
